HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.4099 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.378 of 2017 on the file of the I Additional Judicial Magistrate of First Class at Mancherial.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners/A-2, A-3 and A-5 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-2, A-3 and A-5 in C.C.No.378 of 2017 on the file of the I Additional Judicial Magistrate of First Class at Mancherial, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition, shall stand closed.
