Heard counsel for petitioner and the Government Pleader for Excise appearing for respondents. 2.
Petitioner has filed this Writ Petition challenging the action of the 2nd respondent in not releasing Ford Fiesta Car bearing Registration No.AP-02-Q-2277 seized vide FIR No.29 of 2018 by the 3rd respondent.

Petitioner alleges that the vehicle was seized on the ground that it was carrying black jaggery and alum but the said allegation is false and that the petitioner was falsely implicated.

Having regard to the fact that the petitioner is the owner of the vehicle and if the vehicle is kept idle for long period, there is every possibility of it getting damaged, subject to the petitioner furnishing a Fixed Deposit Receipt, for the amount determined by the Motor Vehicle Inspector concerned as to the value of the said vehicle, to the 2nd respondent and on production of the original RC book, the said vehicle shall be released to the petitioner. However, petitioner shall not alienate the vehicle or change its physical features till the disposal of the FIR No.29 of 2018 registered against him by
the 3rd respondent and he shall undertake to produce the vehicle as and when required by the Court.

The Writ Petition is accordingly disposed of. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
