THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 4288 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'Cr.P.C.') by the petitioner-accused No. 1 to quash the proceedings against him in P.R.C.No. 2 of 2013 on the file of the Court of Judicial I Class Magistrate, Ichapuram, registered for the offences punishable under Sections 3, 4 and 6 of Explosive Substances Act, 1908.

At the hearing, learned counsel for the petitioner has requested this Court to dispense with appearance of the petitioner throughout trial. 3.

This Court in a petition of the present nature cannot pass an order under Section 205 of Cr.P.C. However, liberty is given to the petitioner to file appropriate application before trial Court either under Section 205 of Cr.P.C. or under Rule 37 of Criminal Rules of Practice after serving notice on the respondent and on filing such application, the trial Court is directed to decide the same within a week in accordance with law.

Subject to the liberty given to the petitioner, without touching the grounds urged in the petition, the criminal petition is dismissed. Pending miscellaneous petitions, if any, in this criminal petition shall stand dismissed in consequence. _____________________________ Date: 14-08-2018.
