HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.4100 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.361 of 2018 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A, 406, 420 and 506 of the Indian Penal Code and Sections 4 and 6 of the Dowry Prohibition Act, 1961.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners/A-2 to A-5 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-2 to A-5 in C.C.No.361 of 2018 on the file of the XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, is hereby dispensed with except on the dates when their presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous applications, if any, pending in this Criminal Petition, shall stand closed.
