:{ON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4O88 of 2019 ORDER:
This Crirrinal Petition under Section 438 of Cr.P.C. is filed by the petitioner, who is the sole Accused, seeking anticipatory bail in Crime No.184 of 2Ol9 of Jawahar Nagar Police Station, Rachakonda Commissionerate, Ranga Reddy District, registered for the offences punishable under Sections 447, 427 and 420 of IPC.
The cas() of the prosecution is that the defacto complainant, being the Revenue Inspector of Kapra Mandal, inspected the Government lands in Sy.Nos.285 to 291 of Ambedkar Nagar, Jawaharnagar Village, and found that the petitioner/ AccrLsed illegally trespassed into the said lands and sold plots to different persons through the Notarized Agreement of Sale and thereby cheated the poor people. Basing on the complaint lodged by the defacto complainant, the police registered Crime No. 184 of 2Ol9 for the aforesaid offences agains t the petitioner.
Heard learned counsel for the petitioner/Accused and the learned Ai ditional Public Prosecutor appearing for the respondent Sta,e. Perused the material on record. Learned r:ounsei for the petitioner contends that the petitioner alon3 with others has purchased an extent of Ac.1.OO of land from his vendors through Agreement of Sale
CSD, J Crl.P.No.4088 of 2019 dt.28.03.20i8 for a valuable consideration and got.registered l the same in his name. It is also contended that the petitioner is no way concerned with the alleged offence of encroachment and thereby it cannot be said that the petitioner has cheated any person. It is also contended that the above crime was registered on 29.03.2019 and by this time, most part of investigation might have been completed and that the petitioner is ready to abide by ary of the conditions imposed by this Court and would cooperate with the investigation, if he is released on anticipatory bail in the event of his arrest in connection with the aforesaid crime.
On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above petition. Therefore, by taking into consideration the nature of allegations made against the petitioner and since the petitioner contends that he is a bonafide purchaser of the subject land from his vendors for a valuable consideration, this Court is inclined to grant anticipatory bail to the petitioner by imposing some conditions.
In the result, this criminal petition is allowed and the petitioner/Accused is directed to be released on bail in the event of his arrest in connection with Crime No.184 of 2019 of Jawahar Nagar Police Station, Rachakonda Commissionerate, Ranga Reddy District, on his executing a personal bond for Rs.1O,0OO/- (Rupees ten thousand only) with two local sureties for a like ".rri A"n to the satisfaction of the said ,*"*,*
GSD, J Crl.l'.No.4088 of 2019 J Station House Officer and subject to the condition that the petitioner/Accused would cooperate with the investigation and would report before the Investigating Officer on every Saturday betu,r:en 10-00 a.m. and 6-00 p.m. till completion of investigation and filing of charge sheet, whichever is ea-rlier. As a sequel, miscellaneous petitions pending, if any, sha-Il stand closed.
