HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 10250 of 2016 Order:

The petitioner was appointed as Security Guard through proceedings dated 22.08.2012 on contract basis in SNCU District Hospital by the second respondent. Though the appointment of the petitioner was on contract basis, her services were renewed from time to time and it was lastly extended up to 24.08.2015. It appears that in connection with the missing of a female baby, the Additional Joint Collector, Nizamabad issued instructions to take action against the concerned staff. Accordingly, staff nurse was suspended on 07.08.2015 and another staff nurse was removed from service. The services of the petitioner were terminated on 10.08.2015 based on the letter issued by the fourth respondent. The police traced the missed baby and handed over to her mother. It is the case of the petitioner that in order to cover up the negligence of the third respondent, the third respondent addressed a letter to the fourth respondent to terminate the services of the petitioner. Challenging the proceedings dated 10.08.2015 the present Writ Petition was filed.

2. A counter affidavit was filed by the second respondent stating that the petitioner was on duty on 06.08.2015 in SNCU as Security Guard. The mother of the missing female baby and others submitted a complaint to the District Collector, Nizamabad, on 07.08.2015 with regard to missing of baby. The Joint Collector issued instructions terminating the services of two staff nurses for their negligence. The services of the petitioner were also terminated as the third respondent submitted a report stating that the petitioner is negligent in her duties. However, the representation of the petitioner is under consideration for restoration of her services.

3. In view of the statement made by the second respondent in the counter affidavit filed in the Writ Petition, this Writ Petition is disposed

of directing the second respondent to consider the representation of the petitioner for restoration of her services as stated in paragraph 7 of the counter affidavit and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
