IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH * * * WRIT PETITION No. 28152 of 2015 BETWEEN Kotu Sarat Kumar ... PETITIONER AND The State of Andhra Pradesh, rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabd and others ...RESPONDENTS Date of Order pronounced: 14.09.2015 ORDER:- Heard.

2. The grievance of the petitioner is limited to the extent of seeking hearing and disposal of his appeal viz., RCG(4) 438/15, which is pending before the second respondent. Petitioner states that the said appeal was preferred by the petitioner against the orders of the Revenue Divisional Officer, Nellore dated 19.11.2012 wherein permission was granted in favour of the seventh respondent for conversion of land into nonagricultural land subject to certain terms and conditions.

3. Since the petitioner merely seeks consideration of his appeal, it is not necessary to issue notice to the seventh respondent in view of the order proposed to be passed.

4. It appears that in the said appeal the second respondent fixed the date of hearing of the appeal on 21.02.2015 on which date the petitioner appeared, but the same was stated to have been adjourned on the request of the Revenue Divisional Officer. Subsequently, the appeal was again listed for hearing on 09.07.2015 but was not taken up.

5. Keeping in view that the date of hearing was already fixed by the second respondent, I deem it appropriate to dispose of the writ petition by directing the second respondent to hear the parties at an early date and pass appropriate orders in the said appeal in accordance with law expeditiously. With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
