HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.7492 & 7542 of 2017 COMMON ORDER :

Heard learned counsel for the petitioner/accused No.3 of both C.C.Nos.65 and 105 of 2015 on the file of I-Additional Chief Metropolitan Magistrate, Visakhapatnam, out come of Crime Nos.148 & 209 of 2014 and 147 & 172 of 2014 respectively. 2.

From perusal of police final report, the accusation is for the offence under Section 411 IPC so far as the petitioner. It appears, there is no part-II C.D. in the cases on hand. The material is also insufficient and in one of the cases, charge sheet shows the accusation with some basis and that too the cases are of the year 2015, practically there is nothing to interdict the trial.

Accordingly, both the criminal petitions are disposed of. Learned counsel for the petitioner expressed of the petitioner attending personally for day to day trial from Guntur to Visakhapatnam, liberty left open to move otherwise at all Rule 37 Criminal Rules of Practice, for the other accused willing to represent him or under Section 205 Cr.P.C. to represent through Special Vakalath holder and in such an event, the learned Magistrate to consider on merits and also by virtue of this order. 4.

Miscellaneous petitions pending, if any, shall stand closed in both the criminal petitions.
