THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Writ Appeal No.903 of 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} This appal is preferred against an interlocutory order passed by the Learned Single Judge dismissing the writ petition in so far as the 1st petitioner in the writ petition (1st appellant herein) is concerned on the ground that he is not a beneficiary under the Housing Scheme. Sri Kasa Jaganmohan Reddy, learned counsel for the appellants, would seek permission to withdraw the writ appeal with liberty to the 1st appellant to file a Writ Petition in public interest. If the 1st appellant is able to satisfy the requirement of filing a Writ Petition (Public Interest Litigation), the order under appeal would not disable him from doing so. However, granting liberty to him to file a Writ Petition afresh would amount to setting aside the order of the Learned Single Judge. It would be wholly inappropriate for us, therefore, to grant liberty as sought for.
The Writ Appeal is dismissed as withdrawn. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
