THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.9984 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the memo issued by the second respondent in Rc.No.26/Estt/F.No.90/2004-05, dated 26.04.2004 and the proceedings in Rc.No.2019/Estt/2004-05, dated 02.09.2004, as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to readmit the petitioner into services, as Attender with all consequential benefits. Learned counsel for both parties with one voice submitted that the petitioner attained the age of superannuation on 31.07.2008 i.e., pending writ petition. Therefore, the purpose of filing the writ petition has become infructuous.

However, learned counsel for the petitioner seeks permission of the Court to permit the petitioner to make a representation to the second respondent for appropriate relief. In view of the submission made the learned counsel for both parties, the Writ Petition is dismissed as infructuous. However, the petitioner is at liberty to make a representation to the second respondent seeking any relief, if he is entitled in accordance with law. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
