Heard counsel for the petitioner as well as the respondents. The present writ petition is filed by the petitioner questioning the inaction on the part of respondents 1 to 3 in connection with the impounding of the passport of the 5th respondent, and in issuing a red corner notice against respondents 5 and 6.
Though the writ petition is filed in the year 2007, till date no counter affidavit is filed on behalf of respondents 1 and 2. Admittedly, a crime was registered and by the date of filing of the writ petition, the matter has been investigated and a charge sheet has been filed, and after cognizance, the case was numbered as C.C.No.768 of 2006.
Though the 2nd respondent is obligated to take action on information under the provisions of the Passport Act, 1967, for impounding the passport of the 5th respondent since he is one of the accused in C.C.No.768 of 2006, it is informed by the counsel for the petitioner that no action has been taken as of now. Further, as no information is forthcoming and no counter affidavit is filed, more particularly when the matter is of 2007, this Court feels that a direction to be issued to the 2nd respondent to take action for impounding the passport of the 5th respondent, if not already taken, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.
With the above said observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
