THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4858 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioner/A-1 seeking to grant interim custody of his property i.e., 55 Oxen covered under Crime No.7 of 2016 on the file of the Additional Judicial First Class Magistrate, Tuni.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioner are punishable under Sections 11(1), 11(A), 11(D) and 11(E) of the Prevention of Cruelty to Animals Act, 1960.

4. Case of the petitioner is that he filed an application under Section 457 Cr.P.C., before the Court below and the same was returned on the ground of maintainability and though he resubmitted the application by assigning reasons, the Court below refused to receive the same.

5. Considering the facts and circumstances of the case, the petitioner is directed to submit before the Court below with regard to the maintainability of the petition and on such submission, the Court below is directed to pass appropriate orders in accordance with law.
