O R D E R

The grievance of the petitioner is that he along with his two brothers and mother inherited the subject property and have been in possession and enjoyment of the same. When his younger brother by name Sukka Anjaneyulu was missing, he filed complaint and based on the same, FIR. No.112 of 2017 was registered on the file of 3rd respondent - police station. The private respondent No.4 is claiming that his younger brother, who is missing, has sold the subject land to him, and at his instance, the 3rd respondent - Station House Officer, Police Station, Telkapally, Nagarkurnool District, is calling them to the police station and pressurizing to compromise the matter. The grievance of the petitioner is that in FIR. No.112 of 2017 police have not conducted any investigation. Aggrieved by the action of the 3rd respondent, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Telkapally Police Station, Nagarkurnool District, Telangana State, dated 17.07.2019. In the written instructions, while denying the allegations of the petitioner it is stated inter alia as under:

"It is submitted that the respondent No.3 received a complaint from the petitioner against unknown stating that his younger brother by name Sukka Anjaneyulu is missing and the respondent No.3 registered a case as Cr.No.112 of 2017 for the offence U/s Man

Missing and investigation has been taken up. During the course of investigation, the investigating officer examined L.W.1 and recorded his detailed statement and the same was closed as un-detectable. In this regard the Sub Divisional Officer, Nagarkurnool permitted the investigating officer to file final report as "Un-Detectable" vide proceedings No.325/FR/SDON/2018 dated 27.10.2018 after serving the notice to the complainant, final report is being filed before the Hon'ble Judicial Magistrate of First Class, Nagerkurnool.

It is submitted that the contentions of the petitioner that the investigating officer is calling the petitioner and his family members and threatening them to compromise by surrendering possession is false, baseless, hence denied. It is submitted that the contention of the petitioner that the investigating officer is interfering with the civil dispute and with the possession of the petitioner's land is false, baseless, hence denied."

Recording the above statement made in the written instructions, writ petition is disposed of.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
