ORDER

This writ petition is filed for the following relief: "to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the impugned action of the respondents particularly the respondent Nos.2 & 3 in insisting the petitioner to enter into a compromise of their choice to handover the jewellery, cash, deposit etc., to them at the active instance of the 4th respondent and sending the police men to the place of employment of the petitioner and also to his residence and threatening him to foist some more false cases and subjecting him to severe mental harassment as illegal, arbitrary and violative of principles of natural justice etc. and grant such other relief or reliefs as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case and in the interests of justice."

Learned Government Pleader for Home, based on the written instructions, submits that 4th respondent has given a complaint against the petitioner and three others on 8.4.2016, which was registered by the Station House Officer, Koyyalagudem Police Station, West Godavari District, as a case in Cr.No.75 of 2016 for the offences punishable under Section 498-A IPC & Secs.3 & 4 of the Dowry Prohibition Act, 1961. He further submits that investigation was completed and C.C.No.1248 of 2016 was pending trial before the Judicial Magistrate of First Class, Jangareddygudem. When the police went to the office address of the petitioner at Jubilee Hills, Hyderabad, they were informed that he was on leave.

He also submits that the police never interfered with the civil disputes at any point of time and denied the allegation that they have threatened the petitioner to get the matter compromised with the 4th respondent and the present writ petition is filed only to avoid receipt of summons.

In view of the aforesaid submissions and in view of pendency of the case before the trial Court, the petitioner is directed to co-operate for disposal of the case and the police shall not interfere and harass the petitioner in connection with the said case as the Court is seized of the matter.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 8th February, 2017 rkk[
