HON'BLE SRI JUSTICE S.V.BHATT W.P.No.35915 OF 2016 ORDER:

The petitioner prays for the following relief: "...Writ of Mandamus declaring the action of the officials working under the 3rd respondent in trying to dig the channel through the un-acquired land of the petitioner in Sy. No. 211/5B admeasuring 0.14 cents, Sy.No.214 /4A admeasuring Ac.0.17 cents of Burada village, Regidi Amadalavalasa Mandal, Srikakulam District without acquiring the same as illegal and arbitrary and consequently direct the respondents not to dig the channel through the land of the petitioner unless acquired the same as otherwise I will suffer irreparable loss and injury..."

At request of respondents, the writ petition was adjourned from 25.10.2016 to 27.10.2016 and the matter is taken up today. The Assistant Government Pleader places on record the written instructions from the Department. The operative portion reads thus:

" It is further submitted that the canal works have not been taken up so far between Km 11.00 and Km 11.300 where the alleged encroachment of petitioner's land is located.

It is submitted to the Hon'ble High Court that the respondents have no intention to dig canal in the unacquired land in Survey Nos Burada village of Srikakulam Disrtrcit."
