THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CCCA MP.No.120 of 2017 & CCCA.No.139 OF 2010 JUDGMENT:
The Defendant No.4 in O.S.No.1035 of 2006 on the file of the VII Senior Civil Judge, City Civil Court, Hyderabad, preferred the present appeal against the judgment and decree dated 08.06.2010, by and under which, the Court below, decreed the suit by way preliminary decree allotting 1/ 7th share to the plaintiff and Defendants 1 to 6 therein.

During pendency of the appeal, both parties filed the above CCCAMP.No.120/ 2017, stating that they have entered into compromise and settled the matter out of Court amicably and prayed for recording of compromise and dispose of the appeal in terms of the compromise.

Both the parties to the appeal are present, and they are identified by their respective counsel.

Heard both sides and perused the material on record. 5.
Both the parties have admitted the contents, terms and conditions of the compromise, and in proof thereof, affixed their signatures on the compromise petition in open Court. In the Memorandum of Compromise it is clearly stated and prayed for the relief of declaring the appellant herein as exclusive owner in respect of the suit schedule property, as prayed for in O.S.No.1866
MSKJ,J CCCA.139 of 2010 of 2003 on the file of the VII Senior Civil Judge, City Civil Court, Hyderabad.

In that view of the matter, CCCAMP No.120 of 2017 is allowed and the compromise is recorded. Consequently, the appeal is disposed of in terms of the compromise. No order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
