THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.36329 OF 2015 O R D E R :

In this writ petition, petitioner is seeking interim custody of the commodities seized by the 2nd respondent under a panchanama dt.28.09.2015.

2. It is not disputed that enquiry under Section 6-A of the Essential Commodities Act, 1955 is pending against the petitioner.

3. The learned Government Pleader for Civil Supplies appearing for respondents states that a show cause notice dt.08.10.2015 was also issued to the petitioner by the 2nd respondent to show cause why stocks seized should not be confiscated to the Government, fixing 31.10.2015 as the date for conducting enquiry.

4. Having regard to the above facts, this Writ Petition is disposed of directing the 2nd respondent to complete the enquiry pursuant to the show cause notice dt.08.10.2015 within a period of four (04) weeks from the date of receipt of a copy of this order. The release of the seized stocks to the petitioner shall be subject to the result of the said enquiry. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
