HONOURABLE SRI JUSTICE P. KESHAVA RAO I.A.No.1 of 2020 IN/AND CRIMINAL REVISION CASE No.786 of 2019 COMMON ORDER:
I.A.No.1 of 2020 is filed by the petitioner/second respondent praying this Court to record compromise and to set aside the sentence and imprisonment imposed in Crl.R.P.No.129 of 2018 dated 24.06.2019 on the file of Metropolitan Sessions Judge, Hyderabad, and consequently, set aside the sentence imposed in C.C.No.142 of 2015 dated 22.02.2018 on the file of IX Special Magistrate, Hyderabad.
This Court on 04.09.2020 directed the parties to appear before the Registrar (Judicial) on 10.09.2020 for their identification. The Registrar (Judicial) thereafter shall submit a report to that effect by 21.09.2020. In compliance with the above said order, the parties have appeared before the Registrar (Judicial), who, in turn, has enquired the parties with regard to their identification. But, however, since the name of respondent No.2 was not tallied with the Aadhar card produced by him and his counsel was also not present, the Registrar (Judicial) submitted report dated 10.09.2020 to that effect. Therefore, on 21.09.2020, this Court once again directed respondent No.2 and his counsel to appear before the Registrar (Judicial) with reference to the identification of respondent No.2. In compliance with the said order, respondent No.2 along with his counsel appeared before the Registrar
(Judicial), who, in turn, has enquired respondent No.2 with regard to his identification and the same was tallied with his Voter identity card, and accordingly, he submitted second report dated 28.09.2020 to that effect.
In the light of the arguments made by both the counsel and in view of the memorandum of compromise entered between the parties and in the light of the reports submitted by the Registrar (Judicial), I.A.No.1 of 2020 is allowed.
In view of the orders passed in I.A.No.1 of 2020, the sentence and imprisonment imposed in Crl.R.P.No.129 of 2018 dated 24.06.2019 on the file of Metropolitan Sessions Judge, Hyderabad, and the sentence imposed in C.C.No.142 of 2015 dated 22.02.2018 on the file of IX Special Magistrate, Hyderabad, are hereby set aside. The petitioner is directed to pay a sum of Rs.10,000/- (Rupees ten thousand only) to the High Court Legal Services Committee, Hyderabad, within a period of four weeks from today. Failure to comply with the above said order, the order passed in this criminal revision case automatically stands vacated.
Accordingly, the criminal revision case is disposed of. Miscellaneous petitions, if any, shall stand closed. ___________________ P. KESHAVA RAO, J Date: 21.10.2020.
