THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.27664 OF 2007 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the notification issued by the respondents under Section 4(1) of the Land Acquisition Act, dated 18.11.2007 and the notices issued by them under Sections 9(1) & 10 of the Land Acquisition Act dated 10.12.2007, for acquiring the lands of the petitioners to an extent of Ac.13.20 gts., in Sy.Nos.245/A, 245/AA1 and 253/AA situated at Nereducherla village and Mandal, Nalgonda District, as illegal and arbitrary, and consequently, to set aside the same.

Heard Sri S. Lakshma Reddy, learned Counsel for the petitioners and the learned Government Pleader for Land Acquisition. 3.

When this matter was taken up, the learned Government Pleader informed that the respondents are not intending to acquire the land of the petitioners consequent upon the lapsing of the impugned notification issued under Section 4 (1) of the Land Acquisition Act, and therefore, the cause in the present writ petition does not survive, and even otherwise, by virtue of the interim order passed by this Court on 28.12.2007, the petitioners are in possession and enjoyment of the subject lands and therefore, no further orders are necessary in this writ petition.

Recording the above submissions, the Writ Petition is closed. There shall be no order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
