HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 15796 OF 2015 ORAL ORDER:

This writ petition is filed questioning the action of the District Panchayat Officer-4th respondent in not considering the representation of the petitioner dated 18.4.2015 to take steps to stop lifting of sand allotted to petitioner at Reach 5 (a) Ramp Point at 59.150 KM on KRF bank at Oleru village limits, Bhattiprole mandal, Guntur district.

2. Petitioner entered into lease agreement/form S-6 for lifting 1,05,300 Cubic meters of ordinary sand from specified area at Reach 5 (a) Ramp Point at 59.150 KM on KRF bank at Oleru village limits, Bhattiprole mandal, Guntur for a period of one year or till extraction of 1,05,300 Cubic meters of ordinary sand which ever is earlier. Petitioner having extracted some portion of the sand of permit granted to him, now does not want to carry out the quarrying operations and terminate the lease. Accordingly he has submitted representation dated 18.4.2015 and a letter from his counsel dated 19.6.2015. Petitioner filed WPMP No. 24583 of 2015 to receive additional documents i.e., letter dated 19.6.2015 and postal receipts as evidence of such notice.

3. Heard learned counsel for petitioner and learned Government Pleader for Mines and Geology.

Having regard to the fact that representation of the petitioner dated 18.4.2015 and letter issued by his counsel dated 19.6.2015 seeking termination of lease are pending consideration, without expressing any opinion on merits of issue, the writ petition is disposed of directing the second respondent-Joint Collector and Chairman, DLC Guntur to consider the request of the petitioner for termination of the lease agreement in accordance with the procedure envisaged.

Such a decision in accordance with law shall be taken within a period of one week from the date of receipt of copy of this order and same shall be communicated to the petitioner. No costs. Sequel to the same, miscellaneous petitions, if any pending, are closed.
