RSC, J & TA, J IA.No.1 of 2019 in/& CMA.No.338 of 2018 Dt: 28-03-2019 Common Judgment: (per Hon'ble Sri Justice Raghvendra Singh Chauhan) Both the appellant, Mr. Medabalmi Madhu Chander, and the respondent, Mrs. Medabalmi Pavani, are present before this Court. Both of them have submitted their Aadhar cards, in original, before this Court in order to establish their respective identities. They have also been identified by their respective counsel. The Photostat copies of the Aadhar cards shall be kept in the Court record. Both the parties are ad idem that they have compromised their disputes. They have filed IA.No.1 of 2019 along with an affidavit to that effect. Memorandum of Compromise, dated 24-01-2019, is annexed thereto. The same shall be taken on record.
Both the parties are also ad idem that they wish to annul their marriage, dated 20-11-2013, by mutual consent. Therefore, they have filed an application under Section 13-B of the Hindu Marriage Act, 1955.
Since the parties have been living separately for the last three years, the statutory period of six months is, hereby, dispensed with. Therefore, the marriage, dated 20-11-2013, is, hereby, dissolved.
RSC, J & TA, J IA.No.1 of 2019 in/& CMA.No.338 of 2018 Dt: 28-03-2019 Accordingly, IA.No.1 of 2019 is allowed, and this appeal stands disposed of.
The Registry is directed to draft the decree in terms of the Memorandum of Compromise.
As a sequel, Miscellaneous Petitions, pending if any, stand disposed of as infructuous.
