THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38889 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue an appropriate writ, more particularly one in the nature of writ of Mandamus declaring the inaction of the respondents in considering the representations of the petitioner dated 19-09-2016, 02-10-2016 and 03-10-2016 and taking necessary action against the 5th respondent and his associates who are interfering into the peaceful possession and enjoyment of mine in property bearing H.No.10-2-335/1, Ground Floor, 10-2-335/2, 1st Floor and 10-2-335/2 for II Floor, Vijaya Nagar Colony, Mallepally X Roads, Near Priya Theater, Hyderabad as illegal and arbitrary and consequently declare the action of the 4th respondent in aiding the 5th respondent to dispossess the petitioner and his family members from the said property without following the due process of law as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home and perused the material available on record.

Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 4th Respondent - S.H.O., Humayunnagar Police Station not to interfere with the civil dispute

between the petitioner and the 5th respondent without there being any case registered against the petitioner.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
