HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.802 of 2017 ORDER:
In WP.No.6368 of 2017, this Court granted interim direction, dated 30-03-2017, to the respondents therein not to dispossess the petitioners from the subject land and not to demolish any structures in the subject land. Alleging the violation of said order, the petitioners filed this contempt case.
Basing on the counter affidavit, the learned Standing Counsel for respondent says that the respondent never demolished the structures and never interfered with the possession of the petitioners over the subject land. Learned counsel for the petitioners says that the respondent threatened the petitioner for dispossession and for demolition.
In view of the submissions, learned counsel for the petitioners says that the Contempt Case may be closed, as and when the respondent-authorities violates the impugned order, liberty may be granted to them to file fresh contempt case.
It is to be seen that as on today, even according to the learned counsel for the petitioners, the petitioners are not dispossessed and no structures are demolished, but only there is threat of dispossession and demolition. In
the counter affidavit, it is stated that the respondent is not dispossessing the petitioners.
Recording the same, the Contempt Case is closed. However, it is open for the petitioners to initiate proceedings if there is any violation of orders passed by this Court.
As a sequel to the disposal of this case, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-07-2017 Nvl
