THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42524 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The petitioner states that he made an application, dated 30.10.2015, under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') and the Rules framed thereunder before the Tahsildar, Khammam Rural Mandal, Khammam District, the 4th respondent, for grant of pattadar pass book and title deeds with respect to the land admeasuring Ac.0.38 guntas in Survey Nos.239/A1, A2, A3 and A4 situated at Mallemadugu Village, Khammam Rural Mandal, Khammam District, and also paid the requisite fee in accordance with the Rules. He also states that the survey of the subject land was already completed as directed by this Court in W.P.No.38312 of 2013, dated 27.12.2013. Alleging inaction on the part of the 4th respondent, the present Writ Petition is filed.
It is evident that the proceedings under Form VI-A of the Act are required to be considered in a time span of 45 days. Considering the fact that the statutory application of the petitioner filed under Form VI-A of the Act and the Rules framed thereunder is pending since 30.10.2015, the 4th respondent is directed to consider the said application and pass appropriate orders, expeditiously, preferably within a period of four weeks from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
