In the present writ petition challenge is to the notice bearing No.BPS/357/20/11/2015/GHMC, dated 18.07.2017, issued by the Commissioner, GHMC, rejecting the application submitted for regularisation under BRS.

When the matter is taken up, a primary objection as to the maintainability of the writ petition is taken by the learned Standing Counsel for GHMC Sri.P.Keshavarao that as per Rule 11 of the Rules notified vide G.O.Ms.No.152, dated 02.11.2015, appeal lies to the Committee constituted by the Government and a Committee has already been constituted.
3. In view of the above, this Court deems it appropriate to relegate the petitioner to the said alternative remedy of appeal to the Committee so constituted. Petitioner herein is given opportunity to file appeal before the Committee so constituted within a period of one week from the date of receipt of this order. It is further made clear that if no appeal is filed within the said period, this order will not enure to the benefit of the petitioner herein. There shall be no coercive action in respect of subject properties for a period of two weeks from today.

With the above directions, the writ petition is disposed of. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
