THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10344 of 2014 O R D E R :

This Writ Petition is filed to declare the action of the 4th respondent in issuing notice to the petitioner under Section 91 Cr.P.C. in Crime No. 292 of 2013 on the file of the 3rd respondent police station as illegally and arbitrary.

Learned Assistant Government Pleader for Home has placed on record the written instructions received from the Sub-Inspector of Police, Osmania University Police Station, Hyderabad, as per which, a case was registered in Crime No. 292 of 2013 for the offences punishable under Sections 503, 406, 421, 422 and 506 read with Section 120(B) IPC & Section 156(3) Cr.P.C. of Osmania University Police Station on 23.07.2013 and that the petitioner herein was arrayed as Accused No.3. It is further submitted that after investigation, the charge sheet was filed which was numbered as C.C. No. 462 of 2014 on the file of the IV Additional Metropolitan Magistrate at Nampally and that the said case was ended in acquittal on 03.05.2017.

Inasmuch as the petitioner had challenged issuance of notice under Section 91 of the Code of Criminal Procedure and as the case itself stands closed now, nothing survives in the Writ Petition. Accordingly, the Writ Petition is closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
