THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition Nos.11480, 12185 and 25838 of 2010 COMMON ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The provisions of the Andhra Pradesh Ordinance No.5 of 2010 are under challenge in these writ petitions. The said Ordinance was replaced by the Andhra Pradesh Motor Vehicles Taxation (Amendment) Act 11 of 2010 (for short "Act 11 of 2010") which the petitioners have chosen not to challenge by amending the prayer in the writ petitions. In any event, the validity of Act 11 of 2010 was upheld by a Division Bench of this Court in Khader Basha and others vs. Regional Transport Officer, Chittoor1. The cause in the writ petitions does not, therefore, survive and they are liable to be dismissed.
As the petitioners claim to have deposited 50% of the life tax due pursuant to the interim orders passed by this Court, they shall pay the remaining balance of 50% within four (4) weeks from today failing which it is open to the respondents to take necessary action to recover the life tax due from the petitioners in accordance with law. The Writ Petitions are, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
