HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12691 of 2018 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the endorsement dated 22-12-2017 issued by the 4th respondent in rejecting the case of the petitioners for issuance of caste certificate under SC category though the caste "Dombara" is notified under SC category as being illegal, arbitrary and consequently direct the 4th respondent to issue caste certificates as sought by the petitioners, being minors represented by their father.

Learned counsel for the petitioners states that the case of the petitioners ought not to have been rejected only on the ground that earlier the petitioners were issued caste certificates as belonging to "Dommara" BC-A category, when the mother of the petitioners belong to "Dombara" SC category.

On the other hand, learned Assistant Government Pleader for Social Welfare submits that admittedly the father of the petitioner belongs to "Dommara" BC-A and the petitioners are living under the care of their father and mother following the traditional customs of their father's community.

Learned counsel for the petitioners states that at least the petitioners are entitled for issuance of caste certificate under "Dommara" BC-A category, to which the father of the petitioner belong, but respondents are not issuing the same. Learned counsel for the petitioners also stated that writ petition itself can be disposed off directing the respondents to consider the case of the petitioners under BC-A category.

Inasmuch as case of the petitioners was refused on the ground that the father of the petitioners belong to "Dommara" BC-A category, learned Assistant Government Pleader for Social Welfare also states that the petitioners belong to "Dommara" BC-A category, it is open for the petitioners to make an application for issuance of caste certificate as belonging to "Dommara" BC-A community and on such an application being made by the petitioners, the respondents are directed to consider the same and issue caste certificates to the petitioners as belonging to "Dommara" BC-A category. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
