CVNR,J & MSKJ,J WP.6990 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.6990 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing the respondents to produce the petitioner's son, by name, Mandadi Charankumar (for short "the alleged detenu") before the Court and set him at liberty.

Heard Sri Koona Reddy Anji Reddy, learned counsel for the petitioner.

On behalf of the respondents, respondent No.1 filed counter affidavit, wherein it was inter alia averred that on 03.05.2016, the husband of a woman, by name, Lasya @ Teja, gave a report to the effect that his wife was missing, based on which, Cr.No.77/2016 was registered under the head "woman missing", and that the alleged detenu was shown as suspect in the said case. It was further averred that after the registration of the said crime, the police of IV Town Police Station, Nizamabad, prepared a Look Out notice and sent to all police stations in the district, that during the investigation, the police have obtained the call particulars of the missing woman and found that she was regularly in touch with the alleged detenu before she went missing, that the investigation further revealed that the alleged detenu also went missing from 30.04.2016, the date on which the said Lasya @ Teja was also found missing. While denying the allegation of the petitioner that the alleged

CVNR,J & MSKJ,J WP.6990 of 2017 detenu is in the custody of respondent No.1, it is however stated that all efforts are being made to trace the two missing people. In the light of the above noted averments in the counter, which remained uncontroverted, it is not possible to direct the police to produce the alleged detenu before the Court.

Hence, the Writ Petition is dismissed.
