HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6734 of 2017 ORDER :
Heard learned counsel for the petitioner and learned Public Prosecutor representing the State, before ordering notice to respondents 1 and 2 and perused the quash petition grounds.
The petitioner herein was the respondent in M.C.No.20 of 2014 maintained against him by his wife and minor daughter, who are respondents 1 and 2 herein and by order dated 28.06.2016, the learned Junior Civil Judge, Nidadavole, by elaborate order running in 36 paras, by discussing the evidence, awarded maintenance of Rs.1,500/ - p.m. to the wife and Rs.1,000/ - p.m. to the minor son from the date of M.C. and with reference to PWs.1 to 3 and RWs.1 and 2 and Exs.R1 to R6 including pay slip covered by Ex.R6, as driver of 108 vehicle and the learned Sessions Judge when impugned the same unsuccessful by the petitioner dismissing Criminal Revision Petition No.77 of 2016 on 13.02.2017, by elaborately discussing evidence on record, for nothing to interfere even for this Court invoking Section 482 Cr.P.C. there is neither to sub-serve the ends of justice nor required
interference, much less, shown abuse of process or to interdict the enforcement of the impugned order. Having regard to the above, the Criminal Petition is dismissed for no grounds to entertain, but for, granting four months time from today to pay all the arrears of maintenance.
Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
