M Srihari , Chokkarao S/O. Late M Parameswaram v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.37899 of 2014 ORDER:
Heard.
The petitioner questions the impugned order of Commissioner of Appeals in Case No.V1/484/2010, dated 18-07-2013, whereunder the proceedings under Section 14A of A.P. (Andhra Area) Inams Abolition, Act, 1956 were examined by the Commissioner as a revisional authority and the order of Inams Deputy Tahsildar granting patta to the respondents in the revision was set aside on the ground that no notice was issued by the Inams Deputy Tahsildar. Consequently, the further orders of the 3rd respondent was also set aside and the matter was remanded to Inams Deputy Tahsildar for fresh enquiry and disposal. The said order of remand is questioned in this writ petition.
However, learned counsel for the petitioner fairly states that during pendency of the writ petition, the Inams Deputy Tahsildar has taken fresh enquiry as per the order of the Commissioner of Appeals and has already disposed of the proceedings. Learned counsel also states that aggrieved by the same, the petitioner has filed Appeal No.895 of 2015 before the 3rd respondent. In view of the subsequent events, therefore, the cause in the writ petition does not survive except directing the 3rd respondent to consider the petitioner's aforesaid appeal and pass appropriate orders expeditiously. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
