HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.25388 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondents to regularize the services of the petitioner as Lecturer in Violin-Veena, with all consequential and attendant benefits.

Heard Sri P.B. Vijaya Kumar, learned Counsel for the petitioner and the learned Government Pleader for Higher Education appearing for respondents Nos.1 and 2. 3.

It has been contended by the petitioner that she was appointed as a part time lecturer in Violin in the 3rd respondentinstitution during the academic year 1995-96 and since then, she has been discharging her duties without any complaint. The 3rd respondent college is admitted into grant in aid and she has been working in aided post and when she approached the Management to regularize her services against the regular vacancy, her request was not considered. It has been further submitted that on 13.12.2001, while admitting the writ petition, this Court was pleased to pass interim order directing the respondents to continue the petitioner in service, if the petitioner's services are required until regularly selected candidate is appointed, and by virtue of the said interlocutory order, the petitioner is being continued.

The learned Government Pleader for Higher Education appearing for respondents Nos.1 and 2 submits that if the 3rd respondent college submits proposals, respondents Nos.1 and 2 will consider such proposals for absorbing the petitioner into grant-inaid vacancy. 5.

Having considered the above submissions, this Court is of the view that without expressing any opinion on merits, this writ petition can be disposed of directing respondents Nos.3 and 4 to submit proposals to respondents Nos.1 and 2 for absorbing the petitioner into grant-in-aid vacancy.

Accordingly, the Writ petition is disposed of directing respondents Nos.3 and 4 to send proposals to respondents Nos.1 and 2 for absorbing the petitioner into grant-in-aid vacancy. Upon such proposals being sent, respondents Nos.1 and 2 shall consider the same and pass appropriate orders within eight weeks from the date of receipt of such proposals. No costs.
