THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.9260 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ order or direction more particularly one a Writ in the Nature of Mandamus declaring the action of the respondents 2 to 4 in laying the new B.T road at Sy.No.441 & etc. or in any other survey numbers of Pudoor village limits by changing the original sanction plan is illegal, arbitrary and unconstitutional and consequently direct the respondents 2 to 4 not to dismantle or abandon the existing 33 ft. road abutting to Sy.No.58 of Ananthaapur village limits, Gadwal mandal, Mahaboobnagar District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." The petitioner's representations dated 03.03.2016 and 15.

03.2016 canvassing the grievance aired in this writ petition are pending consideration before the authorities of the Roads and Buildings Department of the State. That being so, this Court does not propose to entertain the writ petition for the purpose of adjudication on merits.

The writ petition is accordingly disposed of directing the authorities concerned to consider the petitioner's representations dated 03.03.2016 and 15.03.2016 and take appropriate action thereon in accordance with law. In the event the petitioner's request is rejected, the authorities shall record the reasons therefor and communicate the same to the petitioner. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order.
