THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25886 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the third respondent Bhadrachalam Gram Panchayat in allowing the tenants of shops of Bhadrachalam Market Yard to use the land of the petitioner as a dumping yard is illegal and arbitrary.

2. Heard learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for third respondent.

3. It is the case of the petitioner that he is having an extent of Acs.3.00 in survey No.67/2 of Bhadrachalam Village. The Settlement Officer, after a thorough enquiry, issued ryotwari patta in Case No.7333 in favour of petitioner's grandmother on 26.5.1979. Out of Acs.3.00 of land, the Government has acquired an extent of Acs.2.96 cents for the purpose of construction of Market Yard in Bhadrachalam. The tenants of the shop of the market yard are using the vacant land of the petitioner (an extent of Ac.0.04 cents) as a dumping yard. The grievance of the petitioner is that in spite of his representation dated 03.6.2016 the third respondent has not taken any action.

4. The only relief sought by the petitioner is to direct the third respondent to dispose of his representation dated 03.6.2016.

5. Having regard to the facts and circumstances of the case, the third respondent is directed to consider the representation of the petitioner dated 03.6.2016 and pass order in accordance with law as early as possible preferably within a period of one month from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand

closed.
