This appeal is filed by the appellant-applicant under Section 30 of the Workmen's Compensation Act, 1923, aggrieved by the order, dated 31.08.2001, in W.C. Case No.323 of 1997 (NF), passed by the Assistant Commissioner of Labour, Nizamabad.

Heard both sides and perused the record.

Having argued for some time, learned counsel for the appellant-applicant had confined his argument to the award of interest only. But, the other side disputed the same and contended that the appellant-applicant is not entitled for any interest.

It is settled legal position that the appellantapplicant is entitled for interest at the rate of 12% p.a. on the compensation amount awarded, from the date of application till the date of realization. Such interest has not been granted in the instant case.

Therefore, the appellant-applicant is entitled for interest at the rate of Rs.12% p.a. on the compensation amount of Rs.44,923/- from the date of application before the Assistant Commissioner of Labour, Nizamabad, till the date of realization.

Accordingly, the Appeal is partly allowed. No order as to costs. Miscellaneous petitions, if any pending in this appeal shall stand closed.
