This Writ Petition is filed for the following substantive relief: "... to issue an appropriate writ or direction more particularly a Writ in the nature of Mandamus declaring inaction of respondent No.2 in registering the FIR pursuant to the complaints dt 05.03.2019, 04.05.2019 and 12.072019 as illegal, arbitrary and unconstitutional and consequently direct respondent No.2 to forthwith register the FIR against respondent Nos3 to 5 and also provide protection to the petitioner's schedule property bearing Plot No.27 admeasuring 200 Sq yards and Plot Nos.28 30, 31 and 32 totally admeasuring 860 Sq yards totalling to 1060 Sq yards situated in Sy.No.126 of Kismathpur Village, Gandipet Mandal, RR District, pursuant to the order dt 04.01.2019 passed in IA No.30/2019 in OS.No.
34/2019 on the file of the Principal Senior Civil Judge, RR District at LB Nagar and be please to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Heard learned counsel for the petitioner who submits that though injunction is granted in favour of the petitioner, the respondent Police is not providing police aid for implementation of same. Learned counsel for respondent No.5 relying on the judgments reported in Vanga Buchi Reddy and others Vs. Vanga Madhusudhan Reddy1, Gaddeppa and Others Vs. Bheemanna and Others2 and Gangupanthula Ranga Rao Vs. Bathula Laxmaiah and others3 submits that an ex parte ad-interim injunction was granted by the learned Principal Senior Civil Judge, Ranga Reddy District, at L.B.Nagar in I.ANo.30 of 2019 in O.S.No.
34 of 2019 in favour of the petitioner and that respondent No.
I.A. and the matter is coming for arguments. As such, the police aid cannot be granted to the petitioner at this stage. The fact that the injunction petition is being heard by the Court below is not disputed by learned counsel for the petitioner. In view of the aforesaid fact and in the light of the laid down in the aforesaid judgments, the Writ Petition is closed with liberty to the petitioner to agitate his grievance after the I.A. for grant of injunction is disposed of by the Court below.
As a sequel, Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
