Mrs. Vishaka Sharma, advocate, representing Smt. M. Bhaskara Lakshmi, learned Senior Counsel for the appellant, would report no instructions.

The present Appeal relates to the year 1997. The suit in O.S. No.38 is of the year 1989, from which the present appeal arises. It appears that the appellant/defendant is not inclined to prosecute the present Appeal.

Hence, the present Appeal is dismissed for non-prosecution. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Appeal Suit shall stand closed.
