THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 14906 OF 2019 O R D E R :

This writ petition is filed challenging the action of respondent No.4 in calling the petitioner to the police station without any case pending against him and forcing him to produce his Aadhar Card and Travel Document i.e. Pass Port, without following due process of law. Learned Counsel for the petitioner submits respondent police have no power to seize the Pass Port, and as such, they cannot ask to produce the Pass Port before them.

Learned Assistant Government Pleader for Home produced written instructions dated 19.07.2019 furnished by the Sub-Inspector of Police, Nalgonda I Town P.S., Nalgonda district, stating that Crime No.78 of 2018 is registered against the petitioner and his father; and that the respondent police are only asking for 'Aadhaar Card' of the petitioner. Recording the aforesaid written instructions the writ petition is disposed of placing the said written instructions on record. However, if any crime is registered, the respondent police are to follow due process in taking further action. It is also open for the petitioner to challenge the registration of crime in Crime No.82/2019, in accordance with law, if he is so aggrieved. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
