THE HON'BLE SRI JUSTICE S.V.BHATT Contempt Case No.2442 of 2015 ORDER :

Heard the learned counsel for the petitioner and Mr.B.Santosh Kumar, holding for Mr.B.S.Prasad. I have perused the order, dated 09-04-2015 in Writ Petition No.9969 of 2015 and the alleged contempt stated in the affidavit filed in support of the contempt case and also the counter-affidavit filed by the respondent.

Having perused the material available on record, I am of the view that no case for proceeding against the respondent under Contempt of Courts Act is made out. Hence, I am not inclined to admit the Contempt Case.

The Contempt Case is dismissed. It is needless to observe that having regard to the complexity of circumstances stated in the counter-affidavit and the need of proper investigation, if the petitioner is so advised, the petitioner can work out the remedies available under law. No order as to costs.

Miscellaneous petitions, if any, pending in this Contempt Case shall stand disposed of.
