Heard learned counsel for the petitioner and learned counsel for the respondents 1 and 2. None appeared for the third respondent in spite of service of notice.

The petitioner joined the service of the first respondent Corporation initially in E-3 Grade on 10.01.1987, whereas the third respondent joined in E-2 Grade in the year 1986. The petitioner claims to be senior to the third respondent. The seniority was maintained till M-1/E-7 Grade. However, due to the benefit of rule of reservation the third respondent was granted promotion earlier to that of the petitioner on 01.08.2009 and later on the petitioner was promoted on 04.09.2010 in E-8 Grade. Even after promotion of the petitioner when catch up rule was not implemented, the present Writ Petition was filed. This Court considered an identical issue in W.P.No.45732 of 2016 and batch dated 29.11.2017 and disposed of the petitions filed by the persons in E-7 and E-8 Grades.

In view of the same, the present Writ Petition is also disposed of in terms of the said order passed in W.P.No.45732 of 2016 and batch dated 29.11.2017. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
