THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9166 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

This Writ Petition was filed challenging the proceedings dated 22.11.2014 issued by the fourth respondent.

A reading of the impugned order shows that the fourth respondent had passed the impugned order on the basis of the report submitted by the Mandal Revenue Inspector, Tripurantakam, and cancelled the temporary dealership of the petitioner. The impugned order also makes a provision for drawing the essential commodities of Srinivasanagar from the Fair Price Shop dealer of erstwhile Somepalli.

It is admitted by the learned Government Pleader that the fourth respondent is not competent to pass the impugned order, that too, without conducting a proper enquiry by giving an opportunity to the petitioner.

In the circumstances, the impugned order passed by the fourth respondent dated 22.11.2014 is set aside and the Writ Petition is allowed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
