HON'BLE SRI JUSTICE SURESH KUMAR KAIT CIVIL REVISION PETITION No.2378 of 2018 ORDER : (Oral) Vide the present petition, the petitioner has challenged the docket order dated 28.02.2018, passed in O.S.No.122 of 2014, by the I-Additional Junior Civil Judge, Tenali, whereby, the document dated 01.01.1994, regarding the passage, has not been allowed to be marked.

In the aforesaid document dated 01.01.1994, it is stated; "By way of this letter, I am leaving this way for your personal purpose. The said way shall be used by you and by your children, legal heirs and the same can be enjoyed by you and by your children and legal heirs with full right and authority. Either myself or my children, legal heirs will not interfere and create any disturbance to you, this was executed by me with my own consent."

The executant of the document has allowed the other side to use the passage and relinquished his rights, as is observed by the trial Court. Therefore, I find no illegality or perversity in the order dated 28th February 2018.

Finding no merit in the present revision, the same is accordingly dismissed. No order as to costs. Pending miscellaneous applications, if any, shall stand closed. ________________________ SURESH KUMAR KAIT, J 17th April 2018 ajr
