2015-09-14R.Kantha Rao2 pages

HON'BLE SRI JUSTICE R. KANTHA RAO W.P.No.29754 of 2015 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in terminating the services of the petitioner vide proceedings dated 22.06.2015 issued by the 3rd respondent, as illegal and arbitrary.

The petitioner was appointed as Field Assistant under MGNREG Scheme in 2009. While so, based on the social audit report and alleging certain irregularities, the 3rd respondent terminated the services of the petitioner vide proceedings dated 22.06.2015.

It is brought to the notice of this Court by the learned counsel appearing for the petitioner that against the order impugned, the petitioner preferred an appeal before the 4th respondent on 30.07.2015. Though in the present writ petition the order impugned is assailed on the ground that it is arbitrary and illegal, I am not inclined to examine the merits of the case in view of availability of an alternative remedy of appeal.

In the circumstances, the Writ Petition is

disposed of directing the 4th respondent to dispose of the appeal duly considering the submissions made by the petitioner within a period of eight weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
