THE HON'BLE Dr JUSTI CE SHAMEEM AKTHER Cr im in al Rev ision Case No.1 0 3 2 of 2 0 1 8 ORDER:

This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973, is filed by the petitioners, challenging the judgment, dated 15.02.2018, passed in Criminal Appeal No.134 of 2016 by the III Additional District & Sessions Judge (FTC), Ananthapuramu, whereby, the order, dated 07.10.2016, passed in Crl.M.P.No.1975 of 2015 in D.V.C.No.24 of 2015, by the learned Special Judicial Magistrate of First Class, Mobile Court, Ananthapur, granting an amount of Rs.6,000/ - per month towards interim maintenance to the 2nd respondent/ wife and her three children, was confirmed.

2 .

Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

3 .

The learned counsel for the petitioners would submit that the trial Court granted an amount of Rs.6,000/ - per month towards interim maintenance to the 1st respondent herein/ wife and her three children. The petitioners belong to agricultural family. They have no sufficient means and ultimately prayed to allow the Criminal Revision Case.

4 .

Granting interim maintenance of Rs.6,000/ - per month to the 2nd respondent/ wife and her three children is not excessive in view of the cost of living now-a-days and other expenses. There is no miscarriage of justice. There is nothing to interfere with the

reasoned orders of both the Courts below. The Criminal Revision Case is devoid of merit and is liable to be dismissed. 5 .

Accordingly, this Criminal Revision Case is dismissed. Miscellaneous Petitions, if any, pending in this Criminal Revision Case, shall stand closed.
