HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.19091 of 2015 ORDER:

Heard learned counsel on either side.

This writ petition is filed seeking to declare the action of the 3rd respondent in terminating the services of the petitioner vide proceedings dated 29.05.2015, as arbitrary and illegal.

The petitioner was appointed as Field Assistant in Garlapeta Village, Marripudi Mandal, Prakasam District, under Mahatma Gandhi National Rural Employment Guarantee Scheme in 2013. While so, the 3rd respondent vide proceedings dated 29.5.2015 terminated the services of the petitioner alleging certain irregularities.

Learned counsel appearing for the petitioner submits that in fact, no enquiry into the allegations levelled against the petitioner was conducted and the impugned termination proceedings were issued without considering the explanation submitted by him. He further submits

that aggrieved by the said termination order, the petitioner preferred an appeal before the 2nd respondent and the same is pending.

Since the appeal is pending before the 2nd respondent, this Court is not inclined to go into the merits of the case.

Therefore, the 2nd respondent is directed to dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition stand closed.
