HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.32616 of 2015 ORDER:

Heard Sri Aravala Rama Rao, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj and Sri MSR Chandramurthy, learned special counsel for respondents 3 to 5. 2 . The petitioner was appointed as Field Assistant at Challaya Valasa Village, Polaki Mandal, Srikakulam District in the year 2007. Basing on the preliminary enquiry report submitted by the Assistant Project Director, Narasannapeta Cluster, the 4th respondent vide proceedings dated 18.04.2015 kept the petitioner under suspension temporarily by framing certain charges. Learned counsel appearing for the petitioner submits that the charges are vague and the petitioner did not involve in any misappropriation of amounts. He also submits that the Sarpanch of the Gram Panchayat and also other persons working in the programme gave representations to the competent authority that the petitioner did not commit any irregularities.

3. Since the impugned order is passed in contemplation of an enquiry, I am not inclined to examine the merits of the said order. In the circumstances, the 4th respondent-Project Director is directed to complete the enquiry against the petitioner, in accordance with law and pass appropriate final orders by taking into consideration the explanation submitted by the petitioner and the material brought by him on record, within a period of four (4) weeks from the date of receipt of a copy of this order, failing which the order of suspension shall stand revoked.

4. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs. __________________ R. KANTHA RAO, J
