THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.14904 OF 2019 ORDER: (per SK,J) This writ petition was filed challenging the e-auction sale notice dated 01.07.2019 issued by the Andhra Bank proposing to hold the auction sale of the secured assets on 17.07.2019. A further direction was sought to the bank to receive the One Time Settlement amount and release the petitioner's residential property. 2.

In so far as the first limb of the prayer is concerned, Sri Murali Manohar, learned counsel representing Smt.V.Dyumani, leaned counsel for the first respondent bank, would inform this Court that the auction held on 17.07.2019 failed for want of bidders. As regards the second aspect, he would point out that the bank had addressed letter dated 03.05.2019 to the petitioner stating its willingness to release her property documents upon payment of the total value of the property, viz., Rs.1,25,70,000/-. The bank acknowledged receipt of Rs.46,00,000/- by way of a deposit and called upon the petitioner to pay the entire amount due before 20.06.2019, failing which, it proposed to initiate necessary action against the petitioner's property as per norms in vogue. 3.

It is an admitted fact that the petitioner failed to pay the amount fully before 20.06.2019.

Sri Murali Manohar, learned counsel, states that even as on date the full amount has not been paid.

In the light of the aforestated facts, we are of the opinion that the cause in this writ petition does not deserve adjudication on merits.
