HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION Nos. 35429, 35454 & 35459 of 2015 COMMON ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) Since the petitioner in these three writ petitions is common and the issue involved in these writ petitions is also common, they are being disposed of by this common order. In these writ petitions, the petitioner seeks Mandamus to declare the action of the respondent Bank in taking physical possession of its properties mentioned in the possession notices, pursuant to the proceedings initiated under the SARFAESI Act, as illegal and arbitrary.

When the matters were taken up on 30.10.2015, it was represented by learned counsel for the respondent Bank that an amount of Rs.3,56,16,572/- is due from the petitioner. While issuing notice before admission, this Court granted interim stay of dispossession on condition of the petitioner depositing half of the amount due within a period of two weeks from the date of passing of the order. Thereafter, on 07.12.2015, there was no representation on behalf of the petitioner and, on the other hand, it was represented by learned counsel appearing for the respondent Bank that the petitioner has not complied with the conditional order dated 30.10.2015. Even on

18.01.2016, there was no representation for the petitioner, and as such, the matters were posted for dismissal today. Today also there is no representation for the petitioner when the matters are called. It appears the petitioner is not interested in pursuing the matters.

Accordingly, the writ petitions are dismissed for nonprosecution. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
