THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 11263 of 2011 ORDER:

The grievance of the petitioners in this case was that the police authorities were interfering with the civil disputes pending between them and respondents 5 to herein. In the writ affidavit they specifically averred that the Deputy Superintendent of Police, Gurajala, Guntur District, was calling them to the police station at Gurajala and pressurising them. According to the petitioners, civil suits were pending between the parties and there was no occasion for the police

authorities to interfere in the matter.

The learned Assistant Government Pleader for Home is unable to shed any light on the issue and no counter affidavit has been filed by the police authorities. Sri Ch. Samson Babu, learned counsel appears for the private respondents, but this Court is not inclined to go into the issues arising between the petitioners and the private respondents. The only issue that falls for consideration before this Court is as to the alleged interference by the police authorities. This Court is not inclined to keep the matter pending awaiting the response of the police authorities. The legal position is well settled that the police authorities are not empowered to interfere in civil disputes. No doubt if the civil dispute has any criminal consequence, the police authorities would be at liberty to register and investigate the crime.

In doing so, they are bound to follow the due procedure laid down by law i.e., the Code of Criminal Procedure, 1973. Presently, there is no indication that any criminal case has been registered by the police authorities be it against the petitioners or against the private respondents. In the event such a case is registered, the police authorities shall abide by the due procedure and shall not exceed their jurisdiction and interfere in their civil dispute. Making this clear, the Writ Petition is closed.

Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
