THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3827 of 2022 ORDER:- This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner, who is arrayed as Accused No.2, in the event of his arrest in connection with Crime No.163 of 2022 of Saidabad Police Station, Hyderabad, registered for the offence punishable under Section 307 read with Section 34 of Indian Penal Code. 2.

Heard the learned Counsel appearing for the petitioner and learned Assistant Public Prosecutorrespondent, for the State. 3.

The case of the prosecution is that, there was an attempt to murder on the de facto complaint by accused No.1 to 4. In the remand report it is mentioned that it was accused No.1 who attacked the de facto complainant and there is no mention of any attack by

this petitioner. For the said reason, the relief of anticipatory bail can be granted to the petitioner. 4.

The Criminal Petition is, accordingly, allowed and the petitioner/Accused No.2 is granted anticipatory bail subject to the following condition:

(1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Saidabad Police Station, within ten days from the date of this order, and, on such surrender, the petitioner is directed to be released on bail on his executing a personal bond to the tune of Rs.25,000/- (Rupees twenty five thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.

(3) The petitioner shall appear before the concerned Police on every Monday and Thursday, for a period of three months.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
